Terminology

In the following terms & conditions “the photographer” refers to Mark Warren photography and its staff.
“The clients” shall be those person or persons defined as bride and/or groom on the booking form.
“Booking” shall be the name used for the actual day that the photography takes place.
“Venue” this shall be the name of the place of the ceremony and or reception or both.
“The Day” the date of the booking.

These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

1. Copyright

The copyright of images taken remains the property of the photographer until all monies owed for the Booking are paid in full.

The Photographer reserves the right to use copies of images taken during the booking for marketing and demonstration purposes and social media advertising and promotion, however, this shall not be until the client has taken full delivery of the edited images.

2. Display

The client(s) hereby allow(s) the photographer / videographers to display any photograph or Film covered by this contract / Booking Form and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.

3. License, Coverage and Reproduction

Photographs taken during the course of the booking will be at the discretion of the photographer although every effort will be made to comply with the client’s requirements.

The photographer shall be granted artistic license in relation to the poses photographed and the locations used.

The photographers judgement regarding these matters shall be deemed correct.

The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.

For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge.

The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs and the photographer may deem that a particular image should be converted to black and white.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

4. Prices

All standard wedding packages (bookings) and additional goods specified on the booking form are supplied at the prices ruling on the date of booking.

Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.

5. Payments

A non-refundable booking retainer of no less than £100.00 will confirm your booking , as well as full acceptance of the terms and conditions as published on the photographer’s website.

The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due.

Payment in full of the remaining balance will be due in full on the wedding day.

Additional goods ordered must be paid for in full at the time of ordering.

Titles to all goods remains with the photographer until paid for in full by the client(s)

6. Force Majeure

The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.

In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

7. Ownership

All digital negatives remain the property of the photographer. On all occasions, the photographer will supply a copy of the edited digital negatives to the client(s) for their own non-commercial use. All RAW files will not be passed to the client.

8. Cancellation Fees

  • I. The booking retainer is none refundable if the booking is cancelled by the client
  • II. If the day of the booking is changed after the retainer has been paid, a new retainer is required and the initial retainer is none refundable and none deductible against the final client bill
  • III. Cancellations made within 3 month of the wedding incur the full cost of the basic photographic service booked, including optional additional attendance.

The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

Where the photographer is able to re-book the cancelled date with an equivalent booking then the cancellation fee will be reduced to the booking fee.

9. On The Day & Optional Evening Cover

The photographer is the only authorised and official photographer for your wedding day.

The earliest the photographer will work on any wedding day is two hours before the ceremony and the latest shall be 8,30pm.

Weddings are booked and charged on a per hour basis i.e. 4 hour wedding, 6 hour wedding, 8 hour wedding. The photographer shall not be responsible for not capturing certain images due to the event going over time or scheduled times of the day being moved. In certain circumstances where the photographer is required to stay after the agreed hired time, this can be accepted or declined by the photographer depending on circumstance and an additional charge will be made for this time.

10. Personal Accident

Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

All wedding albums & Canvasses are collected or posted to the customer via courier at no extra cost, 2 – 3 weeks after notification of the images to use , where possible.

The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, lighting especially man-made fibres. It is sometimes impossible to photography digitally the exact colour as seen by the human eye.

All images will be adjusted for exposure, brightness, contrast, sharpness, etc The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artist finishing is done by the photographer to the best of his / her ability and to do their utmost to ensure the images are pleasing to the eye, however, a person’s individual opinion or comment shall not be accepted.

14.

The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used.
The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

15.

The photographer shall not be responsible for the loss, theft or deletion of images during or following the booking.

This agreement shall be governed in accordance with the laws of England Scotland and Wales. The terms of this contract are accepted by the client and it is assumed that the terms have been read and accepted by paying the retainer.
